Esta política explica qué datos recaba Bar Clandestino, para qué los usamos y qué derechos tiene usted. El bar es un speakeasy virtual operado desde Santa Marta, Colombia.

This policy explains what data Bar Clandestino collects, how we use it, and the rights you have. The bar is a virtual speakeasy operated from Santa Marta, Colombia.

1. Quiénes somos1. Who we are

2. Solo mayores de 18 años2. 18 and older only

El bar es un espacio para adultos. No está dirigido a menores de 18 años y no recabamos datos a sabiendas de personas menores de esa edad. Si cree que un menor se ha registrado, escríbanos para que cerremos la cuenta.

The bar is an adults-only space. It is not directed at anyone under 18, and we do not knowingly collect data from minors. If you believe a minor has registered, write to us so we can close the account.

3. Datos que recabamos3. Data we collect

Cuando se hace socio o usa el bar, podemos guardar:

When you join or use the bar, we may store:

• Correo electrónico y un hash de su contraseña (nunca guardamos la contraseña en texto claro).Email address and a hash of your password (we never store the password in plain text).
• Nombre que elige mostrar en el bar y su número de socio.The display name you choose and your membership number.
• Foto de perfil, si decide subir una.A profile photo, if you choose to upload one.
• Su pueblo o ciudad y país de origen, y el lugar donde se encuentra ahora, si decide indicarlos. Ambos son opcionales y puede borrarlos cuando quiera.Your home town and country, and where you are now, if you choose to add them. Both are optional and you can clear them at any time.
• Mensajes que escribe en los salones públicos y en los reservados (chats de grupo o privados).Messages you write in the public rooms and in private booths (group or one-to-one chats).
• Pedidos de bebidas y comida virtuales, propinas y recargas del monedero o la billetera.Orders for virtual drinks and food, tips, and purse or wallet top-ups.
• Identificadores de transacciones de PayPal (por ejemplo, el identificador de la orden y de la captura). No guardamos datos de tarjetas: PayPal procesa el pago.PayPal transaction identifiers (for example order id and capture id). We do not store card details: PayPal processes the payment.
• Fecha de alta, último acceso e idioma preferido (español o inglés).The date you joined, when you were last seen, and your preferred language (Spanish or English).

4. Pagos4. Payments

Si recarga su monedero, el pago lo procesa PayPal. Nos llegan confirmaciones con el monto, la moneda, el estado y los identificadores de la transacción, no el número de su tarjeta ni los datos completos de su cuenta bancaria. El uso que PayPal hace de sus datos se rige por la política de privacidad de PayPal.

If you top up your purse, PayPal processes the payment. We receive confirmations with the amount, currency, status and transaction identifiers, not your card number or full bank details. How PayPal uses your data is governed by PayPal’s own privacy policy.

5. Funciones con inteligencia artificial5. AI-powered features

Algunos personajes habituales del bar y ciertas funciones (por ejemplo, traducir un mensaje o responder en el salón) usan inteligencia artificial de proveedores externos. Para que funcionen, podemos enviar al proveedor el texto pertinente de la conversación y datos mínimos de contexto. Esos proveedores tratan el contenido según sus propias condiciones. Esta divulgación es solo para transparencia legal: dentro del chat, los personajes del bar se mantienen en su papel.

Some of the bar’s regular characters and certain features (for example translating a message or replying in the room) use artificial intelligence from third-party providers. To make that work, we may send the provider the relevant conversation text and minimal context. Those providers handle that content under their own terms. This disclosure is for legal transparency only: inside the chat, the bar’s characters stay in character.

6. Cookies, almacenamiento local y la app6. Cookies, local storage and the app

Usamos una cookie de sesión para mantenerlo conectado mientras está en el bar, y un token de seguridad asociado a esa sesión. En el navegador también podemos guardar preferencias (como el idioma) y avisos ya vistos en el almacenamiento local. Si instala la aplicación en su teléfono o tableta (PWA), el dispositivo puede guardar una copia básica de la interfaz para usarla sin conexión limitada. No usamos redes de publicidad de terceros para rastrearlo por internet.

We use a session cookie to keep you signed in while you are at the bar, and a security token tied to that session. We may also store preferences (such as language) and notices you have already seen in local storage. If you install the app on your phone or tablet (PWA), the device may keep a basic copy of the interface for limited offline use. We do not use third-party advertising networks to track you across the web.

7. Invitaciones y el parámetro ?ref7. Referrals and the ?ref parameter

Si llega al bar con un enlace de invitación (por ejemplo ?ref=0069), podemos recordar de forma temporal el número de socio que lo invitó, en la sesión o en una cookie, para asociar su cuenta nueva con esa persona. Eso nos permite mostrar quién invitó a quién. No vendemos esa información.

If you arrive through an invitation link (for example ?ref=0069), we may temporarily remember the inviting member’s number in the session or a cookie so we can associate your new account with that person. That lets us show who invited whom. We do not sell that information.

8. Para qué usamos los datos8. How we use the data

• Crear y mantener su cuenta, su tarjeta de socio y su foto.To create and maintain your account, membership card and photo.
• Mostrar el chat, los reservados, quién está en cada salón y sus lugares, si los compartió.To show chat, booths, who is in each room, and your places if you shared them.
• Procesar pedidos, propinas y recargas, y llevar el saldo virtual de su monedero o billetera.To process orders, tips and top-ups, and keep the virtual balance of your purse or wallet.
• Traducir mensajes y operar las funciones del bar, incluidas las que usan inteligencia artificial.To translate messages and run the bar’s features, including those that use artificial intelligence.
• Moderar el espacio, atender reportes y bloquear cuentas cuando hace falta para proteger a los socios.To moderate the space, handle reports and block accounts when needed to protect members.
• Cumplir obligaciones legales y responder a solicitudes que la ley nos imponga.To meet legal obligations and respond to requests the law requires us to handle.

9. Con quién los compartimos9. Who we share them with

No vendemos sus datos. Los compartimos solo cuando es necesario para operar el bar: con PayPal si recarga, con los proveedores de inteligencia artificial o traducción que hacen posible ciertas funciones, y con el alojamiento técnico del sitio. Otros socios ven lo que usted publica en los salones o reservados que comparte con ellos (nombre, foto, mensajes y, si lo indicó, sus lugares). Si la ley nos obliga, podemos entregar información a una autoridad competente.

We do not sell your data. We share it only when needed to run the bar: with PayPal if you top up, with the artificial-intelligence or translation providers that make certain features work, and with the site’s technical hosting. Other members see what you post in the rooms or booths you share with them (name, photo, messages and, if you added them, your places). If the law requires it, we may provide information to a competent authority.

10. Conservación10. Retention

Conservamos la cuenta y el historial mientras sea socio. Los mensajes, pedidos e identificadores de pago se guardan para que el bar funcione y para llevar una contabilidad básica. Si cierra su cuenta, borramos o desidentificamos lo que ya no necesitamos, salvo lo que la ley nos pida conservar (por ejemplo, un registro mínimo de una transacción).

We keep your account and history while you are a member. Messages, orders and payment identifiers are stored so the bar can function and so we can keep basic records. If you close your account, we delete or de-identify what we no longer need, except what the law requires us to keep (for example a minimal record of a transaction).

11. Sus derechos11. Your rights

Conforme a la Ley 1581 de 2012 de Colombia (habeas data) y, cuando apliquen, principios equivalentes a los del RGPD y de leyes como la CCPA, usted puede:

Under Colombia’s Law 1581 of 2012 (habeas data) and, where they apply, principles similar to the GDPR and laws such as the CCPA, you may:

• Conocer, acceder y actualizar los datos que tenemos sobre usted.Know, access and update the data we hold about you.
• Pedir la corrección de datos inexactos o incompletos.Ask us to correct inaccurate or incomplete data.
• Solicitar la eliminación de su cuenta y de datos que ya no sean necesarios.Request deletion of your account and of data that is no longer needed.
• Oponerse o limitar ciertos tratamientos, cuando la ley lo permita.Object to or limit certain processing, where the law allows.
• Pedir una copia de los datos que nos haya proporcionado, en un formato razonable.Ask for a copy of the data you have given us, in a reasonable format.
• Presentar una queja ante la Superintendencia de Industria y Comercio de Colombia, o ante la autoridad de su país si le corresponde.Lodge a complaint with Colombia’s Superintendence of Industry and Commerce, or with the authority in your country if that applies to you.

12. Cómo pedir que cerremos su cuenta12. How to ask us to close your account

Escríbanos a hola@barclandestino.co pidiendo la eliminación de su cuenta. Verificaremos que la solicitud viene de usted y procederemos a cerrarla. El saldo virtual del monedero o la billetera no se devuelve en dinero: es saldo de la casa, no dinero real (vea los Términos).

Write to hola@barclandestino.co and ask us to delete your account. We will verify that the request comes from you and then close it. A virtual purse or wallet balance is not paid out as cash: it is house credit, not real money (see the Terms).

13. Seguridad13. Security

Protegemos el sitio con conexión cifrada (HTTPS), contraseñas almacenadas como hash, y acceso de administración limitado a los propietarios. Ningún sistema es perfecto; si detecta un problema de seguridad, avísenos de inmediato.

We protect the site with an encrypted connection (HTTPS), passwords stored as hashes, and administration access limited to the owners. No system is perfect; if you spot a security problem, please tell us at once.

14. Transferencias internacionales14. International transfers

El bar se opera desde Colombia, pero el alojamiento, PayPal y los proveedores de inteligencia artificial o traducción pueden tratar datos en otros países. Al usar el bar, usted entiende que sus datos pueden cruzar fronteras para que el servicio funcione.

The bar is operated from Colombia, but hosting, PayPal and the artificial-intelligence or translation providers may process data in other countries. By using the bar, you understand that your data may cross borders so the service can function.

15. Cambios15. Changes

Podemos actualizar esta política. La fecha de la última actualización aparece arriba. Si el cambio es importante, lo indicaremos en el sitio. El uso continuado del bar después de un cambio significa que ha leído la versión nueva.

We may update this policy. The last-updated date appears above. If a change is material, we will note it on the site. Continued use of the bar after a change means you have read the new version.
