Estos términos rigen el uso de Bar Clandestino, el speakeasy virtual en barclandestino.co. Al entrar, registrarse o usar el bar, usted acepta estos términos y la Política de privacidad.

These terms govern your use of Bar Clandestino, the virtual speakeasy at barclandestino.co. By entering, joining or using the bar, you agree to these terms and to the Privacy Policy.

1. El bar1. The bar

Bar Clandestino es un bar virtual de estilo años 20, operado por Christopher Kesl desde Santa Marta, Colombia. Entrar, conversar, usar los reservados y disfrutar de la primera bebida del día es gratis. Pagar es opcional y nunca bloquea una función del bar.

Bar Clandestino is a 1920s-style virtual bar, operated by Christopher Kesl from Santa Marta, Colombia. Coming in, chatting, using booths and enjoying the first drink of the day is free. Paying is optional and never gates a feature of the bar.

2. Solo mayores de 18 años2. 18 and older only

Debe tener al menos 18 años para hacerse socio. Al registrarse declara que cumple esa edad. No se permite contenido ni conducta que involucre a menores.

You must be at least 18 years old to become a member. By joining you represent that you meet that age. Content or conduct involving minors is not allowed.

3. Su cuenta y su tarjeta3. Your account and membership card

Al unirse recibe un número de socio y puede ver y descargar su tarjeta de socio, con anverso, reverso y un código QR que apunta a su perfil en el bar. La tarjeta es un recuerdo digital del bar, no un documento oficial ni un título negociable. Debe mantener su contraseña en secreto y avisarnos si cree que alguien más usa su cuenta. Podemos pedirle que actualice su foto o sus datos si incumplen estas reglas.

When you join you receive a membership number and can view and download your membership card, with front, back and a QR code that points to your profile at the bar. The card is a digital keepsake of the bar, not an official ID and not a negotiable instrument. You must keep your password secret and tell us if you think someone else is using your account. We may ask you to update your photo or details if they break these rules.

4. El monedero o la billetera no es dinero real4. The purse or wallet is not real money

El saldo de su monedero o billetera es saldo virtual de la casa. No es dinero de curso legal, no genera intereses, no se puede cambiar por efectivo, no se puede transferir a otra persona fuera del bar y no se puede retirar. Sirve solo para pedir bebidas o comida virtuales y dejar propinas dentro de Bar Clandestino. Si cierra su cuenta, ese saldo se extingue.

The balance in your purse or wallet is virtual house credit. It is not legal tender, earns no interest, cannot be redeemed for cash, cannot be transferred to someone else outside the bar, and cannot be withdrawn. It is only for ordering virtual drinks or food and leaving tips inside Bar Clandestino. If you close your account, that balance ends.

5. Recargas de 10 dólares5. Ten-dollar top-ups

La única recarga disponible es de 10,00 USD, procesada por PayPal. Es opcional. Las recargas no son reembolsables, salvo cuando la ley aplicable lo exija. No emitimos reembolsos desde el propio bar; si la ley le reconoce un derecho de reembolso, contáctenos en hola@barclandestino.co y, cuando corresponda, el trámite se hará a través de PayPal.

The only top-up available is USD $10.00, processed by PayPal. It is optional. Top-ups are non-refundable, except where applicable law requires otherwise. We do not issue refunds from inside the bar itself; if the law gives you a right to a refund, contact us at hola@barclandestino.co and, when it applies, the process will run through PayPal.

6. Bebidas y comida virtuales6. Virtual drinks and food

Las bebidas y los platos de la carta son entretenimiento digital. No se envía comida ni bebida física. Una vez pedidos, se muestran en el bar por un tiempo (unos quince minutos) y luego desaparecen. Puede invitar un trago a otra persona que esté en el salón: el costo sale de su saldo virtual.

The drinks and dishes on the menu are digital entertainment. No physical food or drink is shipped. Once ordered, they appear in the bar for a while (about fifteen minutes) and then fade. You may buy a drink for someone else who is in the room: the cost comes from your virtual balance.

7. Normas de conducta7. Conduct

Queremos un salón cortés. Usted se compromete a no:

We want a courteous room. You agree not to:

• Acosar, amenazar, acechar o humillar a otras personas.Harass, threaten, stalk or humiliate other people.
• Publicar odio, discriminación o violencia dirigida a alguien por quién es.Post hate, discrimination or violence aimed at someone for who they are.
• Enviar spam, publicidad no pedida o mensajes repetitivos que molesten a la sala.Send spam, unsolicited advertising or repetitive messages that disrupt the room.
• Compartir contenido ilegal, o material que involucre a menores.Share illegal content, or any material involving minors.
• Suplantar a otra persona, incluidos los propietarios o los personajes de la casa.Impersonate another person, including the owners or the house characters.
• Intentar entrar sin permiso a cuentas, datos o zonas de administración del sitio.Attempt unauthorized access to accounts, data or the site’s administration areas.
• Usar el bar para fraude, estafas o cualquier actividad ilegal.Use the bar for fraud, scams or any illegal activity.

8. Moderación, bloqueos y expulsiones8. Moderation, blocks and bans

Los socios pueden bloquearse entre sí. Los propietarios pueden ocultar o quitar mensajes, silenciar o bloquear una cuenta, o cerrarla si incumple estos términos o pone en riesgo a otras personas. Podemos hacerlo sin previo aviso cuando sea necesario para proteger el bar. Si cree que hubo un error, escríbanos a hola@barclandestino.co.

Members may block one another. The owners may hide or remove messages, mute or block an account, or close it if it breaks these terms or puts other people at risk. We may do so without prior notice when needed to protect the bar. If you think a mistake was made, write to hola@barclandestino.co.

9. Personajes de la casa9. House characters

En el bar hay personajes habituales. Algunas de esas presencias y funciones relacionadas usan inteligencia artificial de proveedores externos, como se explica en la Política de privacidad. Están ahí para ambientar el salón y conversar; no sustituyen consejo profesional (médico, legal, financiero o de viaje) y no deben usarse para contenido ilegal o para acoso.

The bar has regular characters. Some of those presences and related features use artificial intelligence from third-party providers, as explained in the Privacy Policy. They are there to set the room’s mood and to converse; they are not a substitute for professional advice (medical, legal, financial or travel) and must not be used for illegal content or harassment.

10. Su contenido10. Your content

Usted sigue siendo dueño de lo que escribe y de la foto que sube. Nos concede una licencia limitada para mostrarlos dentro del bar (en los salones, reservados, perfiles y tarjeta) y para operar, traducir y moderar el servicio. No use material que no tenga derecho a compartir.

You remain the owner of what you write and of the photo you upload. You grant us a limited license to display them inside the bar (in rooms, booths, profiles and the card) and to operate, translate and moderate the service. Do not use material you do not have the right to share.

11. Propiedad del bar11. The bar’s property

El nombre Bar Clandestino, el diseño, la carta, los textos del sitio, la tarjeta de socio y demás elementos de la casa nos pertenecen o los usamos con derecho para operar el bar. No puede copiarlos para otro servicio ni dar a entender que representa al bar sin nuestro permiso.

The Bar Clandestino name, design, menu, site copy, membership card and other house elements belong to us or are used with the right to operate the bar. You may not copy them for another service or imply that you represent the bar without our permission.

12. Sin garantía12. No warranty

El bar se ofrece «tal cual» y «según disponibilidad». No prometemos que el servicio esté siempre disponible, libre de errores o ininterrumpido. Pueden ocurrir mantenimientos, fallos técnicos o cambios en las funciones.

The bar is provided “as is” and “as available.” We do not promise that the service will always be available, error-free or uninterrupted. Maintenance, technical faults or changes to features may occur.

13. Límite de responsabilidad13. Limitation of liability

En la medida que permita la ley colombiana, Bar Clandestino y Christopher Kesl no responden por daños indirectos, lucro cesante, pérdida de datos o perjuicios que resulten del uso o de la imposibilidad de usar el bar, ni por lo que otros socios digan o hagan. Nuestra responsabilidad total, si la hubiera, no superará el monto que usted nos haya pagado en recargas de PayPal durante los tres meses anteriores al reclamo, o 10 USD si no ha recargado. Nada en estos términos excluye la responsabilidad que la ley no permite limitar, incluida la que corresponda por dolo o culpa grave.

To the extent Colombian law allows, Bar Clandestino and Christopher Kesl are not liable for indirect damages, lost profits, lost data or harm that results from using or being unable to use the bar, nor for what other members say or do. Our total liability, if any, will not exceed the amount you paid us in PayPal top-ups during the three months before the claim, or USD $10 if you have not topped up. Nothing in these terms excludes liability that the law does not allow us to limit, including liability that applies for willful misconduct or gross negligence.

14. Cambios a estos términos14. Changes to these terms

Podemos actualizar estos términos. La fecha de la última actualización aparece arriba. Si el cambio es importante, lo indicaremos en el sitio. Si sigue usando el bar después de un cambio, acepta la versión nueva. Si no está de acuerdo, deje de usar el bar y pídanos que cerremos su cuenta.

We may update these terms. The last-updated date appears above. If a change is material, we will note it on the site. If you keep using the bar after a change, you accept the new version. If you do not agree, stop using the bar and ask us to close your account.

15. Ley aplicable15. Governing law

Estos términos se rigen por las leyes de la República de Colombia. Cualquier disputa se someterá a los jueces competentes de Santa Marta, Magdalena, Colombia, sin perjuicio de los derechos irrenunciables que le otorgue su lugar de residencia.

These terms are governed by the laws of the Republic of Colombia. Any dispute will be submitted to the competent courts of Santa Marta, Magdalena, Colombia, without affecting non-waivable rights you may have where you live.
